The Supreme Court of Appeal (SCA) in Bloemfontein is expected to rule on former president Jacob Zuma’s parole appeal on Monday.

Zuma and the Department of Correctional Services challenged the High Court order, which declared his parole irrational, illegal and unconstitutional.

The Democratic Alliance (DA) previously told the SCA that former correctional services commissioner Arthur Fraser was wrong to believe he had the authority to release Zuma on health grounds.

The party insists Zuma is neither terminally ill nor physically unfit to serve time behind bars. In June last year, the Constitutional Court sentenced him to 15 months in prison after he breached an order to appear before the State Seizure Commission.

Zuma’s lawyers have since insisted that Fraser acted within the law when he released him on health grounds.

In documents submitted to the SCA, the legal team claims Zuma was examined by three doctors who confirmed his illness.

The team, led by lawyer Dali Mpofu, claims that the DA, the Helen Suzman Foundation and AfriForum filed the subpoena even though they did not have the former president’s detailed medical records to ascertain his condition.
