DURBAN – The state in the case of Bonginkosi Khanyile said he deliberately delayed his incitement trial.
Khanyile asked for the adjournment, saying he wanted to add a new lawyer to his defense when he appeared in the Durban Regional Court.
He also claims that the state was late in turning over some documents in the case.
And with the case now adjourned until Friday at the request of the defendants, the state said it was a delaying tactic to prevent a trial.
The state was poised to proceed with the case of one of the accused in the July riots, Bonginkosi Khanile, for the next two weeks.
State prosecutor Yuri Gangai said that he tried repeatedly to get a lawyer for Khanile, but he never got there.
He also accused Khanile of delaying the case.

“It appears to your mercy that the defendants in this matter have no interest in pursuing this case or allowing it to move forward,” Gangai said.
He said that if Khanile had been interested in the trial as planned, he would have prepared.
“The accused knows that he had a lawyer to prepare for today, and he did not consult him at all,” Gangai said.
The case will return to court on Friday and is expected to continue as the judge told the defendants that the trial must begin.
